DAMI Terms of Service

Welcome to our products and services (provided by the DAMI service provider, “we,” “us,” or “our”). This Service Agreement applies to all products and services we provide to you through websites, software clients, and new forms that may emerge with technological development.

Please read and fully understand each term of this Agreement, especially terms that limit or exclude liability, and decide whether to accept them. Limitation and disclaimer terms may be highlighted in bold for your attention. Unless you read and accept all terms of this Agreement, do not download, install, or use this software and related services. Your click to agree, download, install, use, log in, or similar actions constitute your acceptance of this Agreement.

You legally agree that these terms are binding rules (“Terms”). You also agree to our Privacy Policy, Cookie Policy, payment verification policy, and agree that you are responsible for complying with applicable local laws. Our Privacy Policy, payment policies, and other policies form part of this Agreement. We may change these Terms from time to time. If we do, we will notify you of material changes by posting on the website or sending email. New versions of the Terms do not apply retroactively; we will state the exact effective date when published at the top of this Agreement. If you continue to use DAMI software and services after changes, you accept the new Terms. We reserve all rights not expressly granted in this Agreement, including all rights in the system.

Violation of any provision of this Agreement may result in termination of your account. You agree to use DAMI software and services at your own risk.

If you entered into an offline agreement with us related to these services before or after signing this Agreement (“Offline Agreement”) and that Offline Agreement remains in effect, where the Offline Agreement conflicts with this Agreement, the Offline Agreement prevails; for matters not covered by the Offline Agreement, this Agreement applies.

1. Account Terms

You must be at least 18 years old to register a DAMI account, or old enough to enter a binding contract where you live. If you are under 18, you may not use DAMI products without consent from a parent or guardian (who agrees on your behalf that you will comply with the Terms of Service).

You must register to use DAMI, choose an account name, and set a password. Your information will be collected and disclosed in accordance with applicable data protection laws and our Privacy Policy. All users must provide true and accurate information when registering; do not use invalid or another person’s email address.

We reserve the right to verify all user information and refuse any user. You are responsible for all activity under your account and for keeping your password confidential. You agree to notify us immediately of any unauthorized use of your account or other security breach. DAMI is not liable for any loss arising from use of your password or account by others, whether with or without your knowledge.

You may not use DAMI software and services for any illegal or unauthorized purpose. When using the software, you must not violate any laws in your jurisdiction (including but not limited to copyright laws) or other applicable legal requirements.

DAMI accounts are for the registered user only. Gifting, lending, renting, transferring, or selling accounts is prohibited. If we discover or have reason to suspect that the user is not the original registrant, we may suspend or terminate services and cancel the account without notice and without liability to the account holder, including but not limited to loss of communications, data, and information, which you bear at your own risk.

You agree that DAMI may send you advertisements, promotions, or publicity (commercial or non-commercial) via SMS, email, electronic messages, or other means during service delivery, including through third-party advertisers. You agree to exercise your own judgment regarding advertising in DAMI services; except where law expressly provides otherwise, you are responsible for transactions based on such advertising. You agree that DAMI may report creator information and outreach records (including invitations and direct messages) obtained through your store during service delivery. You agree that DAMI may aggregate creator information into a full creator database and use that database for feature development.

2. Prohibited Conduct

You must comply with applicable laws and regulations and must not use DAMI services or accounts to engage in the following, or facilitate others in doing so:

1. Endangering national security, leaking state secrets, subverting state power, undermining national unity, or harming national honor and interests;
2. Promoting cults or feudal superstition;
3. Spreading rumors, disturbing social order, or undermining social stability;
4. Spreading obscenity, pornography, gambling, violence, murder, terror, harassment, vulgar content, or inciting crime;
5. Insulting or defaming others or infringing others’ lawful rights;
6. Infringing intellectual property, trade secrets, or other lawful rights;
7. Using the software to fabricate facts or conceal truth to mislead or deceive others;
8. Conducting illegal internet activities such as betting or gambling games;
9. Deleting or altering all rights-management electronic information on the software;
10. Intentionally circumventing or breaking technical measures taken by copyright owners to protect the software;
11. Violating regulations by deleting, modifying, adding to, or interfering with computer information system functions, causing systems to malfunction;
12. Accessing computer networks or using network resources without permission;
13. Deleting, modifying, or adding to computer network functions without permission;
14. Deleting, modifying, or adding to data or applications stored, processed, or transmitted in computer networks without permission;
15. Disrupting normal operation of the software system or website or intentionally spreading destructive programs such as computer viruses;
16. Reselling DAMI products or sub-users under authorized admin accounts in any manner;
17. Any other conduct that endangers computer network security;
18. Other conduct that violates public order and good morals or is prohibited by laws and regulations.

You agree not to use any software or device (manual or automated) to “crawl” or “spider” any part of DAMI, or to disassemble or reverse engineer any DAMI content.

You understand and agree that if you engage in any prohibited conduct, use DAMI for illegal or unauthorized purposes, or otherwise violate this Agreement, DAMI may impose penalties based on reasonable judgment for violations of laws or this Agreement, take appropriate legal action against violators, and report information to authorities as required by law, and you alone bear all resulting legal liability.

You understand and agree that if your conduct causes any third-party claims, demands, or losses due to violation of this Agreement or related terms, you shall bear independent liability; if DAMI suffers losses, you shall compensate DAMI as well. If DAMI bears liability first under an effective judgment, award, or similar instrument, DAMI may recover the full amount from you.

3. Fees

Please visit our payment policy page for pricing and current offers for all services. Some DAMI features are free; others require payment. If you agree to our payment policy and order paid features, you agree to pay the applicable fees. Prices for all services (including but not limited to monthly subscription fees) may change.

We reserve the right to change or discontinue the Service (or any part of it) at any time, with or without notice. DAMI is not liable to you or any third party for any modification, price change, suspension, or termination of the Service.

When you use a specific method to become a paid member, you must read and confirm the relevant user agreement and instructions.

4. Refund Policy

DAMI does not provide refunds for any paid services. All payments are final.

After becoming a paid member, you may choose not to accept DAMI products or services and may apply to cancel membership, but you will not receive a refund of any service fees.

5. Termination

This Agreement takes effect when you accept these Terms and remains in effect until terminated by either party. DAMI may suspend or terminate your account or services at any time for any reason, which may deactivate or delete your account, limit access, and delete or clear all content in the account, without compensation. DAMI reserves the right to refuse service to anyone at any time for any reason.

You may contact us through official website customer service at any time to terminate. Note that after account termination, access to certain parts of our website or services may be blocked immediately. We may terminate this Agreement with you if:

1. You violate applicable laws when using our website or services;
2. You violate this Agreement or the terms of the website or services;
3. We reasonably believe your conduct legally harms our business interests.

6. Intellectual Property

All content, design, text, charts, images, logos, buttons, icons, interfaces, audio, video, and all arrangements thereof on the DAMI website or products are the exclusive property of DAMI or the respective content providers and are protected by applicable copyright law. All software used on the website is the property of DAMI or respective suppliers and is protected by copyright and other applicable laws and treaties. Users must not send or upload content that infringes others’ copyright or other intellectual property to this website.

All trademarks, service marks, and trade names used on the DAMI website or products (collectively, “Marks”) are owned exclusively by DAMI. Such Marks may not be used on any non-DAMI product or service, or on any product or service that causes consumer confusion or disparages DAMI in any way.

7. Confidentiality and Feedback

We value your privacy. Our Privacy Policy is incorporated into this Agreement; please review it to understand our privacy practices. All information we collect is governed by our Privacy Policy. By using the website or services, you consent to all measures we take regarding your information under the Privacy Policy.

You agree to keep confidential information confidential, not use it for purposes other than performing this Agreement, and not disclose DAMI confidential information known to you to third parties. Any suggestions, information, ideas, or feedback you provide about DAMI software or services, including documentation reporting errors discovered while using the software or related services (collectively, “Feedback”), will belong to the Company. You agree to assign to DAMI all rights, title, and interest worldwide in Feedback, including related intellectual property, without charge, and agree to assist us in perfecting and exercising those rights.

8. Disclaimer

We recommend that you back up data regularly. You are always responsible for mitigating loss. This software is not fault-tolerant and is not designed or intended for use in hazardous environments requiring guaranteed safe performance or operation. DAMI does not warrant that the website or products containing the Service will be error-free or uninterrupted, or that the website, Service, or servers are free of harmful components. DAMI makes no representation or warranty that the services provided are accurate, complete, or useful. DAMI does not warrant that your use of the website or services is lawful in any particular jurisdiction and expressly disclaims any such warranty.

We do not intervene in disputes between users or between users and third parties regarding use of the Service. When you use the Service, you agree that DAMI will be held harmless from any claims and demands related to such disputes and the Service (whether known or unknown, suspected or unsuspected, disclosed or undisclosed). You bear all consequences of using the DAMI website or services and are fully responsible for any harm or loss caused to any party by your conduct.

Any user who uses, tests, or evaluates DAMI assumes all risk regarding quality and performance. We are not liable for any form of damage, including but not limited to direct or indirect damage arising from use, execution, or delivery of DAMI, even if DAMI has been advised of the possibility of such damage.

Some jurisdictions do not allow limitation or exclusion of liability for incidental or consequential damages, so the above limitations or exclusions may not apply to you. In any event, our liability shall not exceed the purchase price you paid for DAMI. The above disclaimers and limitations apply whether or not you accept, use, evaluate, or test DAMI.

9. Account Cancellation

How to apply: To cancel your DAMI account, use the “Account Cancellation” entry under Basic Information in your account center on the DAMI official website and follow the on-screen steps. Alternatively, contact our official customer service with proof of identity, account information, and reason for cancellation.

Conditions: The account must be in normal use with no compromise risk; have no unfinished transactions, unsettled balances, or unresolved disputes; and not be involved in violations of platform rules or laws. If not, the system will prompt you to resolve issues before continuing.

Review and processing time: We will complete review within 3 business days after receiving your request. Once approved, cancellation begins immediately. We may back up account data during cancellation for periods required by law; backup data is used only for legal obligations and dispute resolution, then deleted or anonymized under strict security standards.

Consequences: After cancellation, you cannot log in with that account. All personal information (including profile data, outreach records, order records, etc.) will be deleted or anonymized and cannot be recovered. Associated benefits (membership, virtual assets, etc.) will expire. Please handle important information and benefits before applying.

Important: Account cancellation is irreversible. Confirm you understand the consequences before submitting. Contact customer service if you need help during the process.
